Jaime Cambreleng and Carmen Cañete analyse club liability for discriminatory supporter conduct in LawInSport

Our lawyers Jaime Cambreleng and Carmen Cañete have published an article in LawInSport analysing two recent Court of Arbitration for Sport (CAS) awards concerning a football club’s liability for discriminatory conduct by its supporters during UEFA Champions League matches.

The cases concern two separate incidents: a mass chant directed at Pep Guardiola at the Santiago Bernabéu and a Nazi salute performed by a supporter during a match in London.

The article examines, among other issues, the strict liability regime applicable to clubs for supporter misconduct, the scope of CAS review of disciplinary sanctions and the circumstances that may be relevant when assessing proportionality.
